At Plum Check, Inc. ("PlumCheck"), your privacy is important to us. Our Privacy Policy describes the information we collect, how we collect it, the reasons we collect it, and how we share or use the information we collect. This Privacy Policy also describes the choices you have with the information we collect, including how you can manage, update, or request to delete information.

I. What is PlumCheck?

PlumCheck is a software as a service platform that allows individuals to share verified identification and health information with dating and social media application users and others.

II. Key Terms & Definitions

  • Smartphone Users: Consumers using smartphones.
  • PlumCheck App: Any web-based or mobile application operated by PlumCheck.
  • Personal Information: Any information relating to an identified or identifiable individual.
  • Our Services: Identity verification and health status verification.
  • Website(s): Including www.plumcheck.io.
  • PlumCheck / we / us / our: Plum Check, Inc.

II.1. When does our Privacy Policy apply?

This Privacy Policy describes the types of information we may collect when you use our Services and/or PlumCheck App, when you visit our Website, or when we communicate electronically or by telephone with you.

II.2. When does our Privacy Policy not apply?

This Privacy Policy does not apply to information collected by any other website operated by us or third parties, unless the website is listed above or links to this Privacy Policy. It also does not apply to any website that we provide a link to or that is accessible from our Services.

This Privacy Policy is incorporated into our Terms of Use, which also apply when you use our Services.

III. Personal Information

III.1. What is Personal Information?

Personal information is information from and about you that may be able to personally identify you. We treat any information that may identify you as personal information. For example, your name and email address are personal information.

III.2. What types of Personal Information do we collect?

  • Personal Identifiers: Name, birth date/age, email address, address, or telephone number.
  • Account Information: Account name or online identifier.
  • Health Information: Health or medical information, including data pertaining to sexual health such as test results (including HIV test results), diagnoses, and vaccination status.
  • Sexual Orientation & Gender: Gender, gender identity, and information concerning sexual life or sexual orientation.
  • Electronic Activity: IP address, device mode, device ID, advertising ID, OS version, device language, operating system, browser type, and information regarding a consumer's interaction with an Internet website or application.

III.3. How do we collect your Personal Information?

From You: We collect most Personal Information directly from you when you use our Services or contact us.

Third Parties: With your consent, we collect Personal Information from third parties including your health care providers, Apple Health and other third-party platforms, and organizations we contract with for identity verification.

Automatically: We collect information automatically as you navigate through our Services using cookies, web beacons, and Google Analytics. You may restrict cookies through your browser settings, though doing so may affect your ability to use parts of our Services.

III.4. How do we use your Personal Information?

  • Provide our Services to you in a user-friendly manner.
  • Provide notices about your account or changes to the Services.
  • Contact you in response to a request.
  • Operate, maintain, and enhance our Services, including monitoring effectiveness and aggregate usage data.
  • Authenticate use, detect fraudulent use, and maintain security.
  • Promote and market our Services to you (you may opt out at any time).
  • Internal testing, research, analysis, and development.
  • Carry out our obligations and enforce our rights.
  • Respond to law enforcement requests, court orders, and subpoenas.
  • Anonymize and aggregate information for analytics and reporting.
  • Any other purpose with your consent.

III.5. How do we share your Personal Information?

Business purposes: We may share your information with vendors, service providers, and business partners including data hosting, analytics providers, technology services, and professional advisors.

With your consent: We share your verified health statuses (such as HIV status, STI screening dates, PrEP/DoxyPEP prescriptions, and vaccination statuses) with other users only with your explicit consent. We may also share with third parties for research purposes with your consent.

Legal compliance: We may share information to comply with applicable law, respond to legal process, or cooperate with law enforcement.

Business transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred.

De-identified information: We may disclose de-identified information, which cannot reasonably be used to identify any individual, for any purpose permitted by law.

III.6. Your choices

You can opt out of email marketing at any time by clicking the unsubscribe link in any marketing email. You may also opt out of targeted advertising through the NAI opt-out page and the DAA opt-out page.

III.7. How do I access and correct my Personal Information?

You can review and change your Personal Information by emailing us at contact@plumcheck.io. You may also contact us to delete your account or correct any errors in your information.

IV. Children's Privacy

We do not knowingly collect or sell Personal Information from children under the age of 18. If you are under the age of 18, do not use our Services. If we learn we have collected Personal Information from a child under 18, we will delete it. Parents or guardians may contact us at contact@plumcheck.io to request deletion.

V. Do Not Track

Some web browsers have a "Do Not Track" feature. PlumCheck is not currently set up to respond to those signals.

VI. Data Security

We have implemented administrative, technical, and physical safeguards designed to protect against unauthorized access, alteration, destruction, or disclosure of data. We strive to use best practices and industry-standard security measures. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee the security of Personal Information transmitted to or through our Services.

VII. California's "Shine the Light" Law

California Civil Code Section 1798.83 permits California residents to request certain information about our disclosure of Personal Information to third parties for their direct marketing purposes. PlumCheck did not share Personal Information for third parties' own direct marketing purposes in the prior calendar year.

VIII. Changes to Our Privacy Policy

We may update our Privacy Policy periodically to reflect changes in our practices, laws, and best practices. If we make material changes, we will notify you by email. The date this Privacy Policy was last revised is identified at the top of the page.
